Indemnification Policy
You agree to use all SocialVPS.net services and facilities at your own risk. SocialVPS.net specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall SocialVPS.net be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential, or other damages. Customer agrees that it shall defend, indemnify, save, and hold SocialVPS.net harmless from any and all demands, liabilities, losses, costs, and claims, including reasonable attorney’s fees asserted against SocialVPS.net, its agents, its customers, officers, and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it’s agents, employees or assigns. Customer agrees to defend, indemnify, and hold harmless SocialVPS.net against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with SocialVPS.net server.
SocialVPS.net reserves the right to intervene with any registered Forex VPS operated on its servers in the interest of its customers. Any material supplied by the customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to the customer from SocialVPS.net server. SocialVPS.net shall be the sole judge of what violates this Policy.
Billing
We accept PayPal, Wise, CC MasterCard, Visa, Local Indonesia Bank, Bank Malaysia, and Bank Singapore payments. At this time, we bill on a monthly, quarterly, semi-annual, and annual basis, depending on the selected plan.
There are no contract periods, but for each successive billing period, your contract is automatically renewed unless canceled. Cancellation can be done at any time during the valid billing period.
Refund Policy
Please note that SocialVPS.net does not provide any refunds for VPS products or services. Once a VPS product is activated and the service has commenced, we are unable to offer refunds due to the nature of the services provided.
When you purchase a VPS from us, we begin preparations immediately, which include allocating resources such as electricity, servers, and manpower, all of which are specifically prepared for your use during the rental period. As we cannot cancel electricity plans, resell servers, or terminate related services on short notice, we are unable to provide refunds once the service is initiated.
However, if the product you receive differs from what was agreed upon, we will review your case for a possible refund or resolution.
Cancellation
If you wish to cancel your VPS service, you may do so at any time. However, no refunds will be issued for any canceled VPS services, regardless of the time remaining in the billing period or the reason for cancellation.
Non-Refundable Services
Dedicated Servers and discounted products are non-refundable. No pro-rated refunds will be offered for any VPS services or additional products.
The refund policy does not apply to customers who have breached any Terms & Conditions, or whose account has been terminated or suspended due to a breach.
Amendments to the Refund Policy
SocialVPS.net reserves the right to amend or withdraw this refund policy at any time, without prior notice.
Late Payments
All accounts/servers are billed according to the dates they were first activated on. If you do not pay for service renewal within 2 days after deactivation, your server will be suspended. If you do not pay for service renewal within 3 days after deactivation, your server will be terminated.
Services renewal
Your service will automatically be renewed, and your chosen payment method will be charged at the end of each service period, repeating the length of the previous service period, unless you decide to cancel your subscription to SocialVPS Services.
The system will send a new invoice for the renewal 10 days before the current service period ends. Please note that automatic payments only apply to PayPal. For other payment methods, renewal must be processed manually.
Acceptable Use Policy
All services provided by SocialVPS.net may be used for lawful purposes only. Transmission, storage, or presentation of any information, data, or material in violation of any Hong Kong law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secrets and other statutes. The subscriber agrees to indemnify and hold harmless SocialVPS.net and its employees from any claims resulting from the use of the service that damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Pornography is prohibited on all SocialVPS.net servers. This includes sites that include sexually explicit or hardcore images and/or advertising.
Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, the subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.
Subscriber further acknowledges that the company’s liability for its own negligence may not, in any event, exceed an amount equivalent to charges payable by the subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss, or injury
Illegality In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material. Undesirable Content Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez, and IRC is not allowed. Software, audio, and video downloads may only be hosted if you are the writer and copyright owner of the resources and if you have a right to distribute the materials. Accounts suspended due to content or AUP violations are not refunded under any circumstances.
Banned Scripts
The following scripts are banned from use on our servers and may not be uploaded or run. Reasons for banning them include adverse effects on server load, invitations to hackers/spammers/criminal activity, etc.
- IRC egg drops
- Proxy servers
- Mail bombers
- Anonymous mailers
Limitation of liability
SocialVPS.net shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from SocialVPS.net servers going offline or being unavailable for any reason whatsoever. Furthermore, SocialVPS.net shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any website from one of SocialVPS.net servers. All damages shall be limited to the immediate termination of service.
Disclaimer
SocialVPS.net cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits that a client would have gained if their site was functioning. Certain services provided by SocialVPS.net are resold. Thus, certain equipment, routing, software, and programming used by SocialVPS.net are not directly owned or written by SocialVPS.net. Moreover, SocialVPS.net holds no responsibility for the use of our client’s accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as SocialVPS.net sees fit. FURTHERMORE, SocialVPS.net retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.
Service Level Agreement
We guarantee that our network, data center, and power will be functioning 99.99% of the time on any given month, with the following exceptions:
- Any period prior to the problem being reported by you to our support team.
- Scheduled maintenance windows and emergency maintenance windows.
- Planned migrations.
- Server shutdown due to account suspension.
- Factors outside our control, such as force majeure events, failure of our upstream providers, or your ISP.
- Software running within your virtual servers.
- Actions of third parties, such as server compromises, denial of service attacks, and viruses.
- User activity errors.
Hardware Guarantee
In the unlikely event of unfixable server hardware failure, we guarantee that hardware will be replaced within 24 hours of the problem’s diagnosis.
Hardware is defined as the processor(s), RAM, hard disk(s), motherboard, NIC card, and other related hardware included with the server. This guarantee excludes the time required to rebuild a RAID array and the reload of certain operating systems, processors, and applications. It does not include any bespoke server hosting solutions.
Our parts and labor warranty covers all parts and labor costs involved in the event of a related parts failure. We replace all failed components at no cost to the customer.
Eligibility for Refunds
Credit Reversal and Refund Policy
At SocialVPS.net, we maintain a clear and fair policy regarding the reversal and refund of credits added to customer accounts. This policy is designed to provide transparency and consistency in our financial dealings, ensuring a fair approach to handling refund requests.
Credit Balance Refund Minimum
Refund requests for credit balances can only be made if the balance is equivalent to or greater than 100,000 IDR (approximately 7$ USD). Refunds will be processed to the original payment method or as applicable to the account. There is no time limit for credit refunds as long as the credit remains available in the customer’s account.
Account Credit Utilization
Customers are encouraged to utilize their account credits as they see fit. While credits can be used indefinitely, refund eligibility is dependent on the minimum refund requirement being met (100,000 IDR or approximately 7$ USD).
Exceptions
Any exceptions to this policy will be made at the sole discretion of SocialVPS.net and will only be considered under extraordinary circumstances, such as technical issues or account-related disputes. These exceptions will be handled on a case-by-case basis, and SocialVPS.net reserves the right to approve or deny them.
Notification
Customers are responsible for keeping track of their account credits and the balance available for refund. SocialVPS.net is not obligated to notify customers regarding the eligibility of their credits for a refund. It is the customer’s responsibility to ensure that the credit balance is sufficient for a refund request.
